17 October 1997

Police report stating that my daughter complained about sexual abuse by one (son of my housemaid) (NOTE THAT HER BROTHER IS NOT MENTIONED, AND THE DSWD WAS INVOLVED)

Please note that at this time there is not one hint of any allegation against me as having sex with a minor. This is merely a defensive ploy by Shay Cullen to discredit me. If he had any proof, why did he not act?

The medical examination came back as hymen intact, so boy was punished and banished from my home to his home in Olongapo City some 33 kilometers (about 20 miles) away, forbidden to return, and has to this date never stepped foot in my house again or anywhere in the township of San Antonio, Zambales to my knowledge, but Shay Cullen states in documents that he continues to rape my daughter long after he was removed from San Antonio. A judge made a snide comment that it was only one bus ride to my house. I point out that I can get on a bus that passes by my house and go on the same bus more than 160 kilometers away; so how far is far enough? Do I have to leave country because my neighbor’s septic tank backs up? Same difference! This was a cruel comment, totally unnecessary. What should I have done if the boy had lived next door?

A later finding (unfortunately, not documented) was that my daughter was at a Girl Scout campfire, and when told it was time to go home, she said her stomach hurt. The teacher asked her if she had been sexually abused (remember that she was six years old at that time), and she said yes. When asked by whom, she pointed to (my housemaid's son), who teased her about his bicycle. The teacher promptly reported to the police and the DSWD that she had a case of sexual abuse for no less than ten times. Medical result: HYMEN INTACT. This was told to me by the social worker who accompanied my daughter to the hospital. In one of his sworn affidavits (later), Shay Cullen tries to make it appear that I am criminally negligent for not obtaining the medical report. Since when is is it a crime to not get a medical report?

I ask you, raped ten times and still have an intact hymen? One or two, possible for a hymen to remain intact if no penetration done, three or four, doubtful but perhaps a hymen could withstand such assault, five or six, severely doubtful , seven or eight without a ruptured hymen extremely unlikely, but TEN???? Ridiculous!!! And Shay Cullen says that the boy did it at least ten times and (my son) did it two more (Note in his documents how often ages and events are changed by a factor of two. More on this point later), a total of twelve times, from which she survived with an intact hymen. I’m sorry, but I refuse to persecute children for such weak evidence. Because of that stance, I am branded as pressuring the boys to have sex with my daughter, and more, that I was at the same time having sex with the boy’s sister. More on this development later.

29 January 1998

Preda called the NBI in Olongapo and the DSWD in San Fernando, calling for an emergency rescue of my daughter for sexual abuse. This is confirmed by two separate and distinct sworn statements. The interesting point is that they DID NOT consult the police until after the fact that they were all assembled and had already had custody of my daughter. Nor did they confirm the presence or absence of the maid's son at the school or in the area.

Worse, the note that was left for me said that my daughter was ADOPTED (she was born fifteen [15] months after her mother and I were wed).

Then all that was done was report what they had done for the police records, the NBI being more powerful than the local police, and the worker detailed by the Regional DSWD office was not even from this area, although she was also more senior than the local workers, who had no choice but to abide by their superiors’ decisions. Note the time on the police report and the mention of only he son of the maid being involved:

Please note the time my daughter is placed into the custody of Preda, which is located only 45 KM (about 28 miles) from San Antonio (second paragraph - 1540 means 3:40 PM). I point this out because Shay Cullen submitted not one, but TWO (2) log entries in his counter affidavit (Next page).

And if you think the documents you read here were damaging, wait until you feast your eyes on the pages that follow this one! I'm being serious now. Preda is trying to destroy my family and I and I must retaliate with the truth. And the truth hurts Preda much more than I.
